2. Description of Service

DesignCheck provides automated visual design review services for GitHub pull requests, including:

Automated screenshot capture across multiple devices and viewports
Visual annotation and feedback tools
GitHub integration for pull request workflow
Team collaboration features
Design approval workflows

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our service. By using DesignCheck, you represent and warrant that you meet these requirements.

4. Account Registration

4.1 GitHub Authentication

You must authenticate via GitHub OAuth to create an account. You are responsible for maintaining the security of your GitHub account.

4.2 Account Responsibility

You are responsible for all activity under your account
You must notify us immediately of any unauthorized use
You must not share your account credentials
You must provide accurate and complete information

5. Subscription and Billing

5.1 Pricing

DesignCheck is offered at $19/month with a 14-day free trial. Pricing is subject to change with 30 days notice to existing subscribers.

5.2 Payment Terms

Subscriptions are billed monthly in advance
Payment is processed through Stripe
All fees are non-refundable except as required by law
Failed payments may result in service suspension

5.3 Free Trial

New accounts receive a 14-day free trial
No credit card required for trial signup
You may cancel anytime during the trial without charge
After trial expiration, subscription begins automatically if payment method is on file

5.4 Cancellation

You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing period
No refunds for partial months
You retain access to your account until the end of the paid period

6. Acceptable Use

You agree not to:

Use the service for any illegal purpose
Violate any applicable laws or regulations
Infringe on intellectual property rights
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the service
Use automated tools to access the service without permission
Resell or redistribute our service without authorization
Reverse engineer or decompile our software

7. Intellectual Property

DesignCheck and all related trademarks, logos, and service marks are our property. Our software, website content, and design are protected by copyright and other intellectual property laws.

7.2 Your Content

You retain ownership of all content you submit to our service, including:

Screenshots of your application
Annotations and comments
Repository code and data

You grant us a limited license to process, store, and display your content solely for the purpose of providing our service.

8. Data and Privacy

9. Service Availability

We strive to provide reliable service, but we do not guarantee:

Uninterrupted or error-free service
Specific uptime percentages

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGNCHECK SHALL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, USE, OR GOODWILL
SERVICE INTERRUPTIONS OR ERRORS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless DesignCheck, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any rights of another party
Your content

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Termination

We reserve the right to suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Fail to pay fees when due
Use the service in a way that causes harm or legal liability

Upon termination, your right to use the service ceases immediately. We may delete your data in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the modified Terms.
